This Platform is owned by Curated Living Solutions(under the brand name “Curated Living Solutions”). Curated Living Solutions operates, controls and manages the Services (as defined below) provided by it from its corporate office at 20th Floor, Ireo Grand View Tower, Golf Course Extension Road, Sector 58, Gurugram, Haryana 122102 (“Corporate Office”) and registered office at 210/C-1/1, 2nd Floor Amber Tower, Commercial Complex, Azadpur, New Delhi, 110033 (hereinafter referred to as “Curated Living Solutions”).

Definitions

  1. “Platform” The Curated Living Solutions Website and Mobile Applications are jointly referred as Platform.
  2. “Partner” An individual or a firm that provides sales leads to Curated Living Solutions.
  3. “Payment/Payout” Commission of the Partner payable upon confirmed booking.
  4. “Password” means a secret word or phrase or code or passphrase or secret key, sockets or encryption or decryption keys that one uses to gain admittance or access to information.

General Terms

All references to “you” or “your” or “user” as applicable, mean the person that accesses, uses, and/or participates in the Platform in any manner.

By using the platform you agree to be bound by the Terms of Use, Privacy Policy and Payment Terms (defined below) published over Curated Living Solutions Website www.LOCLliving.com and ‘Nexus’ Mobile Application.

You are solely responsible for safeguarding your Curated Living Solutions password and, if applicable, your Third-Party Site Password (collectively, “Passwords”) at all times. You shall be solely responsible for all activity that occurs on your Account and you shall notify Curated Living Solutions immediately of any breach of security or any unauthorized use of your Account. Similarly, you shall never use another member’s Account without Curated Living Solutions’s permission. You agree that you will not misrepresent yourself or represent yourself as another user of the Platform and/or the Services offered through the Platform.

You hereby expressly acknowledge and agree that you yourself and not Curated Living Solutions will be liable and responsible for consequential, sequential  or any other type of losses, damages etc. (whether direct or indirect) caused by an unauthorized use of your Account. Notwithstanding the foregoing, you may be liable for all the losses of Curated Living Solutions or its subsidiaries, joint holders or any  other Party related to LOCL due to such unauthorized use.

You shall be  responsible for uploading various details like scan copy of PAN card and other payment details/ bank account details and also for the authenticity and verification of information . Curated Living Solutions  shall not have any direct, indirect responsibility and shall not be held liable in case incorrect information provided by any Partner.

Payment Terms

Subject to uploading of accurate information provided by the Partner, the payments shall be settled within 30 days from the date of confirmed booking of the leads provided by you over the Platform.

All payments are subject to deduction of applicable income tax deducted at source (TDS) pursuant to Income Tac Act, 1961 as modified from time to time. The TDS will not be deducted for initial payment upto ₹10,000. After cumulative Payout of ₹10,000, Partner may opt to either continue receiving Payout in their account/wallet with a deduction of TDS at the rate of 20% or update their PAN card details. After the verification of the PAN card, 3.75% TDS will be deducted for every successive Payments, as the case may be. 

Once the Partner opts for the choice of either 3.75% or 20% deduction of TDS, TDS for the initial Payout ₹10,000 will also be deducted from subsequent Payments.

The TDS once deducted on Payouts shall not be refundable.

Governing laws and jurisdiction

By using this website, you agree to be bound by the laws of India which govern this website. All disputes shall be referred to the courts of competent jurisdiction of New Delhi, India only.

Curated Living Solutions shall have the right to modify, edit, alter and or change the terms and conditions including but not limited to payment terms published on this platform along with the information and or contents thereof, without prior intimation and you agree to be abide by such modified terms and conditions by using the Platform.

Entire Terms

The Payment Terms, Terms of  Use together with the Privacy Policy and any other legal notices or Additional Policies published by Curated Living Solutions on the Platform, shall constitute the entire agreement between you and Curated Living Solutions concerning the Platform. If any provision of the Payment Terms is deemed invalid by a court of competent jurisdiction or through any modification in any Statues enacted by the Government of India, the invalidity of such provision shall not affect the validity of the remaining provisions of the Payment Terms, which shall remain in full force and effect.

No waiver of any provision of this these Payment Terms shall be deemed a further or continuing waiver of such term or any other terms, and Curated Living Solutions’s failure to assert any right or provision under these Payment Terms shall not constitute a waiver of such right or provision.
